# Upload a judgment

This guides an editor on how to upload new judgments on LII sites.

1. MS Word files:
   1. open file and hold down \<Fn>\<Alt>\<F11> on keyboard \[or \<Fn>\<F11>]
   2. Visual Basic window pops up
   3. type **ActiveDocument.ConvertNumbersToText** in text box at bottom of window
   4. press **Enter**
   5. **Save** file immediately
2. PDF files:
   1. open file and click on **All tools** – menu opens
   2. click **Scan & OCR**
   3. click on **In this file**
   4. click **Recognize text**
   5. **Save** file&#x20;

#### On the admin page dashboard (LII ur&#x6C;**/admin/**), scroll to **judgments** from the list of menu items. Click the green **Add** button to begin.

#### The **Add judgment page** will load. Attach the judgment file (attach PDF only if MS Word file not available). The **Upload Tool** will extract metadata and populate the required fields. The fields with <mark style="color:red;">\*</mark> are compulsory fields and must be populated.

1. Review the **Key details tab:**
   1. &#x20;Jurisdiction = Country in which Order of court applies
   2. Locality = Organ under which Court operates **(AfricanLII uploads only)**
   3. Court = Court handing down judgment
   4. Registry = Seat of Court's Registry (if specified in judgment)
   5. Case name = Applicant/Appellant v Respondent (refer to guide on case naming)
   6. Date = Judgment date
   7. Language = Language that the judgment is written in
   8. Published = box must be **ticked** so judgment appears on site
   9. Hearing date = Date of hearing or last day of proceedings
   10. Must be anonymised = box must be ticked so judgment is not visible on site until anonymisation process completed
   11. Anonymised = box must be ticked **ONLY** after anonymisation process completed
   12. Case action = main issue/legal basis for proceedings
   13. Outcomes = order of court
   14. Serial number override = insert number **ONLY** if court provides neutral citation in judgment
2. Review the **Case numbers tab**:
   1. Year = Year of case number
   2. Full case number as printed on judgment = Case number to be copied and pasted as per judgment
3. Review the **key details tab:**
   1. &#x20;Jurisdiction = Country in which Order of court applies
   2. Locality = Organ under which Court operates **(AfricanLII uploads only)**
   3. Court = Court handing down judgment
   4. Registry = Seat of Court's Registry (if specified in judgment)

   8. Published = box must be **ticked** so judgment appears on site
   9. Hearing date = Date of hearing or last day of proceedings
   10. Must be anonymised = box must be ticked so judgment is not visible on site until anonymisation process completed

5. Under **judges**, enter the name of the judge on the Judgment. For cases with multiple judgments, list the judges in the order they should appear when the judgment is on the site.&#x20;
6. Click **save and continue editing**.

6. Under **case numbers,** enter the case number from the judgment in the string override field. Separate the matter type, number and year in the respective fields.

7. Click **Save** and your judgment will be successfully uploaded.
8. &#x20;Click **view on site** to view the judgment on the site.
9. To make **edits** to the judgment you have uploaded, click view on site, on top left hand corner of the judgment, Click the **edit button.**

7. Make the necessary changes and click save again.


# Overturned and upheld

Link judgments that are overturned or upheld.

The Related judgments tab allows you to select judgments that are **overturned** or **upheld** by the current one.

## Overturned judgments

To choose a judgment that is *overturned* by the current one:

1. Click on the **Predicate** drop-down and select **overturns**.\ <br>

2. Then select the judgment that was **overturned** (the **Subject work**) by clicking on the drop-down. Type in part of the title of the judgment to find it easily.\ <br>

3. Click **Save** or **Save and continue editing**.

## Upheld judgments

To choose a judgment that is *upheld* by the current one:

# Delete a judgment

How to remove a judgment from the site once it has been uploaded.

Once you have editor access on a LII site, you can delete a judgment you have uploaded and for users with administrator rights, you can delete any judgement.

&#x20;

1. Click **Judgments** on your dashboard.
2. **Search** and type the name of the Judgment that you want to delete.
3. Click **delete**

4. To confirm, Click **yes I am sure** and your judgment will be deleted from the system.

# Replace a source file

You can replace source files directly on the site in any of the judgments you have uploaded incorrectly without having to delete them.

1. On the dashboard, go to the judgment list and **search** for the judgment you want to edit.
2. Click on the judgment you want to edit.
3. Select **source files** and click choose file.
4. **Replace** the existing file with the file you want to replace it with.

5. Click **Save**.


# Add multiple case numbers

This is a guide for Judgments with more than one Case Number.

1. Select Judgments on the left-side of the dashboard.
2. Enter the key details, judges and click **case numbers.**
3. Copy the case number from the judgment and enter it in the **string override** field.
4. Separate the **Matter type**, **number** and **Year** and enter them in their respective fields.
5. Click **Save** to add the case number.

6. For a judgment with multiple case numbers, click **Add another case number**.

6. Add the case number and click save again.

**Note: To remove a case number, click the remove button and click save.**


# Attach files

1. On the left-side of your dashboard on the admin page, select **judgments** from the list of menu items.
2. Enter the key details, judges, case numbers and then select the **Attached files** section. Alternatively, If your judgment is already uploaded, you can edit and go to attached files to add a file.

3. Click the **Add another Attached file** to browse, select and add a file from your computer.
4. Click **Save.**

**Note:**&#x20;

* **You can add multiple files by selecting add another file.**
* **You can remove a file you have attached by selecting the remove button and clicking save.**


# Add a judge

1. Sign In to the **Admin page.**
2. Click **Add** judges on the dashboard.

You can also click judges on the menu items on the left side of your page.

3. Click **+Add judges** green button on the top right hand corner of your screen.
4. Enter the judge name.
5. Click **save.**

### Tips:

* When adding a judge name, ensure you apply **capitalization** rules and use the correct format which is Surname J, Surname JA, Surname JSC.

# Principles of law publication

This page provides the general principles guiding the publication of judgments on the web.

## What do we publish?

A Legal Information Institute publishes primary legal materials needed to conduct core legal research as well as appropriate secondary legal materials, such as law journals, law reform commission publications, and academic and other research papers.

When organising a national collection of primary legal materials, the LII will be guided by the doctrine of sources of law applicable to the national legal system.

Therefore, the national collection will focus on sourcing and publishing the following in the order listed:

1. The Constitution
2. Legislation, primary and subsidiary, which may further be organised into subject areas collections
3. Case law in order of importance:
   * Apex court (e.g. Supreme Court)
   * Court of Appeal
   * High Courts, including distinctions into Commercial, Criminal, Civil, etc. divisions
   * Decisions of special courts, tribunals or commissions

## Completeness and Timelines

LIIs publish **ALL judgments** handed down within 24 hours of handing down.&#x20;

Historical judgments are also of importance to legal researchers. The digitisation of historical judgments should be captured in a digitisation plan. &#x20;


# Collection Development Principles

### Comprehensiveness

No distinction is made between Reportable and Unreportable cases. All are published on the LII.

### Authoritativeness

* The LII sources materials directly from the court/tribunal/legislative body/government gazette as much as possible. Using authentic documents from the source is the basis for creating trust in the information and service the LII offers.
* Alternative sources of legal documents will be considered subject to the reliability/ authority of the source and/or validation of content from another source, preferably the court (for judgments) or the Government Gazette/AG office for legislation.

### Currency

* Current cases are prioritised for upload.
* Daily batches of historical judgments are processed whenever possible.

### Language policy

* Judgments are published in their original language.
* Translations thereof, if available, should be clearly identified.
* Case names are designated in the original language of the judgment.

### Authenticity

* Judgments are published in the format - Word or PDF - received from the judge or the court's registry. If judgments undergo any form of digital conversion, the original judgment document is appended to the record.&#x20;
* Judgments consisting of the (dissenting or concurring) opinions of several judges in the same matter will be combined in one document by LII, irrespective of their receipt as separate documents from the Registry or Court Library. **The judgment thus combined will receive a single citation, appearing under one record (page).**

### Format

* Judgments are uploaded on the system in the format supplied by the court registry or judges' secretaries.
* The preferred format is a Word document. &#x20;
* Availability of PDFs is mandatory for scanned judgments. They serve as a verification version where optical character recognition software is used to produce a text/web page version of the judgments published on the LII.

#### Corrections to judgments

* **The LII does not correct judgments**. Not even spelling mistakes! Corrections done by the Court and reflected in a newly circulated judgment, should be clearly indicated on the currently published version of a document on LII. A notice such as this:

<mark style="background-color:yellow;">Editor Note: This judgment has been corrected by the court, and this version was put in place on \[date]</mark>

The notice is to be placed on all versions of the judgement in the very beginning of the document. The past version of the judgment should be kept on file if it needs to be consulted by users and/or the judge. The LII website software makes provision for this function.

### Anonymisation

In principle courts are responsible for ensuring privacy requirements with respect to personal information in judgments are met. However, in some jurisdictions, an LII has a responsibility to redact certain judgments of personal and private details to protect the identity of vulnerable persons and groups in society, especially where the law or a court order requires it.&#x20;

This requirement varies across jurisdictions and each LII should develop its own anonymisation guidelines.&#x20;

### Retrospectivity

* Priority is given to current decisions, i.e. 2005+ must be collected and published. 2005 is approximately the year when courts began to computerise and likely stored judgments in electronic format.&#x20;
* In principle, there is no cut-off date for earlier decisions, but more recent cases will be loaded first, depending on availability.
* Users will be assisted if the collection plan for the LII includes a list of important past reported judgments, and still standing precedents, which are prioritised for scanning and uploading on the service. This creates tremendous value for users with less effort and financial commitment on the part of the LII. A good starting point could be either the electronic publication of the Law Reports or consulting law school books and reading lists for cases most used in law teaching and subsequently in practice. The Laws.Africa and AfricanLII software can identify and list all judgments that have been cited but cannot be found on the system.&#x20;

### MNC - Media Neutral Citaion

* No judgment will be loaded on the LII without a Medium Neutral Citation being assigned to it. Please see below for an explanation of the MNC standard.
* Paragraphed judgments are preferred, however **the LII does not insert paragraph numbers** as this will conflict with the authoritativeness and integrity of the judgment.&#x20;
* The LII should include this issue on its policy engagements with courts of the land. Electronic citation and full adoption of electronic judgments depend on the use of pin-point citation: a combination of the MNC and paragraph numbers in a particular judgment.&#x20;

### Court summaries

* Where courts issue summaries of judgments, the LII should collect them for publication. The system makes provision for the linking or displaying of case summaries in several ways.


# Case naming guidelines

The following Case Naming guidelines are based on case naming conventions in common law countries

## Font style

Proper capitalization of names should be applied. **Using full capitals in case names is highly undesirable and should be avoided**. The practice of using full caps in capturing parties’ can lead to confusion as to the correct spelling of the names of the parties.

e.g. MACDOUGALL” and “MacDougall”<br>

## Language

The case name is created in the same language as the reasons for decision it is assigned to. When a party has a bilingual name, only the name corresponding to the language of the reasons is retained.

## Many cases

When the decision involves many cases, the case name refers to all listed cases, separated by semi-colon

## Name of a Party

The case name refers to a party by a standardised or abbreviated name, as specified in the following subsections, depending upon the party’s type, namely: individual, organization or government body.  All attempts should be made to ensure that a party is referred to consistently in all proceedings and cases in which this party is involved.&#x20;

### Party name

#### Natural persons

Individuals are referred to only by their surname as presented in the decision’s heading, except as otherwise stated in the following subsections. The first name and initials are omitted as well as any title, alias or other descriptive term.

#### Note

In case of uncertainty about how to segregate the surname from the full name – which might happen more often for names with particles, traditional names or names of foreign origin – try to find hints in the decision’s text or try to locate other decisions involving this party. When still in doubt, retain only the last word of the individual’s full name.

#### Legal persons

Legal persons are entities that are involved in litigation. They include companies, government entities, civil society organisations, trusts, etc.

* Close Corporations are usually followed by the acronym ‘CC’. Remember that the ‘CC’ has to be in UPPER CASE.
* Companies are usually followed by ‘(Pty) Ltd’ (for a private company) or ‘Ltd’ (for a public company). These should be included in the case name. If a company trades under another name, then the words ‘trading as’ become simply ‘t/a’.

* The category of legal persons also includes government ministers when they are named by their title and not by the name of the individual who currently holds that title, e.g. Minister of Police (as opposed to Bheki Cele).&#x20;

Example:&#x20;

Absa Bank (Pty) Ltd v Minister of Finance

* **Leave out the word ‘the’ when naming such an entity** e.g. ‘The Member of the Executive Council’ becomes only ‘Member of the Executive Council’.

Example:

Paramount Mills (Pty) Ltd v Competition Commission (as opposed to ‘The Competition Commission’)&#x20;

* Estates of deceased persons are referred to by adding “Estate” before  the surname of the deceased person.&#x20;

Estate Smith v Naidoo

### Ex Parte Matters

In some matters, a person or group of persons makes an application to the court where there is no dispute of fact and therefore no opposing side, such as when someone applies to be admitted as an attorney or someone applies for their insolvent estate to be surrendered. These matters are called ex parte matters. An ex parte application is often connected to another ongoing matter, and this means the citation must include both the ex parte case name and the name of the case it’s related to. For example, a person may apply to be joined in litigation that initially didn’t include them, or a litigant may apply for property in the possession of their debtor to be attached on an urgent basis in the middle of a civil suit. The case name then starts with the words “**Ex Parte:**” (note the colon), followed by the applicant/s name/s, and then the case name of the connected matter follows after a semicolon and the words “**In Re:**”.

* Ex Parte: R M and Another; In Re: R M and Another v Absa Bank (Pty) Ltd and Others&#x20;
* Ex Parte: Special Investigating Unit and Another; In Re: Special Investigating Unit and Another v Ndlovu and Others

### Unknown or Anonymous Person

Unknown or anonymous persons are referred to by the full fictitious name or set of initials used in the decision’s heading, without modification. In rare instances where an individual is not named in the decision, a standard term such as “Unnamed person .

Examples

### Estate of a Deceased Person

Etates of deceased persons are referred to by preceding “Estate” after the surname of the deceased person.

Note

The name of an executor or administrator representing the estate as well as the name of a public trustee acting for the estate should be omitted unless they are also acting personally in the proceedings.

### Individual Acting in an Official Capacity

An individual whose name appears in the decision’s heading merely because of his or her office in an organization or government body, does not act personally. Therefore, the case name should not refer to this individual but to the organization or government body for which he or she is acting in the case.

An alternative style of naming litigants acting in official capacity is to append  ‘N.O’, which stands for Nomine Officio, to the surname of the individual. If there is more than one person whose name is followed by N.O., then we use ‘N.N.O.’  This is the practice of case naming in southern Africa.

* Dr George Ntsikelelo Mahlangu III suing as Director of Christian Barnaard Hospital becomes ‘Mahlangu N.O.’

Note

When an individual is acting both personally and in an official capacity in the case, then the case name refers to this individual when named first.&#x20;

### Ship, Aircraft and Other In Rem Party

When a party listed in the decision’s heading is a thing and no owner is named as a party, this party is referred to by this thing’s name or other identifier – e.g. trademark, model and serial number –, followed between parentheses by a descriptive term such as “Ship” or “Aircraft”, as it appears in the decision’s heading. The name of a ship or vessel should be reproduced as presented in the decision’s heading, including definite articles such as “The” and “Le” if they are part of the name.

### Multiple parties

It’s often the case that there will be more than one person on either side of a matter. Where there are **two people**, the first surname is followed by ‘**and Another**’. Where there are **more than two people**, the first surname is followed by ‘**and Others’**.

Uniform Protection of Identities (Anonymizing)&#x20;

When the identity of a person named in the case name must legally remain undisclosed at some point in court proceedings, the same identity protection should continue throughout any subsequent proceeding in this case as well as in any citation made to this case in other decisions.

The law is not explicit in stating the types of persons whose identity must be protected in published decisions.  Special attention should be paid to:

\-         Persons accused of criminal sex offences, where their name could lead to the identification of a complainant or child witness;

\-         Children and parents involved in proceedings regarding family and child protection;

\-         Young offenders.

Where it is considered to be appropriate to avoid using a name in a decision, the name should be replaced with initials (e.g., “M.L. v. D.L.”). &#x20;

In very rare instances where initials, combined with the facts of the case, would clearly reveal the identity of an individual or of an organization, the letter “X” is used to replace the name instead of initials.  For an additional individual or organization, the letter “Y” is used for the second individual/organization named, then “Z” for the third, “A” for the fourth, “B” for the fifth, and so on.

# Citation

&#x20;In your case management for the LII you will work with two types of citation:

* a **print citation**, e.g. KWADWO v SONO \[1984-86] 1 GLR 7-16, which will be referred to as a law report citation or a parallel citation from now on; and the
* **Medium Neutral Citation** (**MNC**) – a global standard for electronic publication of judgments. The LII system will allow you to display both on the website, thus facilitating the researcher in finding information.

The LII system assigns MNCs automatically unless an editor overrides the assignment by entering the MNC assigned by a court.


# Introduction to the Medium Neutral Citation

This section introduces the editor the Medium Neutral Citation (MNC) standard and paragraph numbering.

The legal profession relies on authority (case-law and legislation) and persuasive secondary legal literature (scholarly works, preparatory works, dictionaries, etc.) to build and present legal arguments. The core purpose of case law citation is to accurately identify a judicial opinion or a part thereof – traditionally, its location in a printed law report series.

In traditional law reporting, case citations do not reflect information about the case itself, but rather identify the year, volume and page number of the law report(s) that contains the judicial opinion. References to specific parts of a judicial opinion (pinpoint referencing) are also in general based on the page number and the paragraph letter.

The digitization of the judicial opinions allows courts to make judgments available immediately through the Internet or other media, in comparison to commercial publishers who take between a month and sometimes years to publish a judgment in the law reports. While obviously impacting the greater accessibility of judicial opinions, the legal profession and the media still need a reliable method for referencing such electronic decisions. Substitutes for the commercial publishers assigned citations and for page numbers must accompany such judgments.

A survey of international practices in this regard shows that courts have taken steps to address these issues by introducing Medium Neutral Citations and Paragraph Numbering within the final versions of judgments.

The Medium Neutral Citation (MNC) allows a resource such as a judgment to be cited irrespective of its publishing medium, namely, in print form or in electronic form, regardless of whether they have been, or will be published in any printed law reports series. The MNC serves as a **permanent unique identifier assigned by the author of the judgment and should remain associated with the judgment wherever it is published in various media or publications.**&#x20;

The MNC enhances the discoverability of judgments across publications, such as commercial law reports series, LII and other websites.

The MNC includes a global identifier of the issuing court, made up of the ISO-3166-1 standard two-letter country code and an abbreviation of the tribunal’s name. This is GH for Ghana, TZ for Tanzania, CI for Côte d'Ivoire.

The MNC should be assigned by the court to the final version (filing and distribution version) of judgments. If the Judiciary does not assign MNCs, the LIIs will automatically assign an MNC based on the order in which the judgment is uploaded on the system, the issuing court, and the year of the judgment.&#x20;


# Construction of the MNC

The MNC is constructed of the case name and the unique core part of the citation.

The MNC includes the **case name** and the **core part of the citation: the year, the court identifier and the sequential number.**

## **Case name**

The MNC standard does not specify the makeup of the case name. This is dependent on the law reporting practices of the jurisdiction in which the court operates. *See section on case naming.*

## &#x20;Core part of the citation:

1. The year element represents the year the decision was handed down, enclosed in square brackets (e.g. “\[2020]”).
2. The court identifier follows the information relating to the year of the decision. Each court has a distinct court identifier. Different seats of the courts (e.g. a high court that has seats in different towns in the country) are not included in the court identifier unless they matter in jurisdictional terms. The LII system can capture registry information.
3. The sequential number represents the consecutive number of the decision in relation to other decisions handed down in a particular year by the particular court.

Republic Vrs High Court (Criminal Division 9) Accra Ex Parte: Ecobank Ghana Ltd and Others, is the sixth judgment handed down in 2022 by the Supreme Court of Ghana, hence the core MNC assigned to the judgment is:

## Font style

Proper capitalization of names should be applied. **Using full capitals in case names is highly undesirable and should be avoided**. The practice of using full caps in capturing parties’ can lead to confusion as to the correct spelling of the names of the parties.

The case name is created in the same language as the reasons for decision it is assigned to. When a party has a bilingual name, only the name corresponding to the language of the reasons is retained.

In case of uncertainty about how to segregate the surname from the full name – which might happen more often for names with particles, traditional names or names of foreign origin – try to find hints in the decision’s text or try to locate other decisions involving this party. When still in doubt, retain only the last word of the individual’s full name.

#### Legal persons

Legal persons are entities that are involved in litigation. They include companies, government entities, civil society organisations, trusts, etc.

* Close Corporations are usually followed by the acronym ‘CC’. Remember that the ‘CC’ has to be in UPPER CASE.
* Companies are usually followed by ‘(Pty) Ltd’ (for a private company) or ‘Ltd’ (for a public company). These should be included in the case name. If a company trades under another name, then the words ‘trading as’ become simply ‘t/a’.

### Ex Parte Matters

In some matters, a person or group of persons makes an application to the court where there is no dispute of fact and therefore no opposing side, such as when someone applies to be admitted as an attorney or someone applies for their insolvent estate to be surrendered. These matters are called ex parte matters. An ex parte application is often connected to another ongoing matter, and this means the citation must include both the ex parte case name and the name of the case it’s related to. For example, a person may apply to be joined in litigation that initially didn’t include them, or a litigant may apply for property in the possession of their debtor to be attached on an urgent basis in the middle of a civil suit. The case name then starts with the words “**Ex Parte:**” (note the colon), followed by the applicant/s name/s, and then the case name of the connected matter follows after a semicolon and the words “**In Re:**”.

### Individual Acting in an Official Capacity

An individual whose name appears in the decision’s heading merely because of his or her office in an organization or government body, does not act personally. Therefore, the case name should not refer to this individual but to the organization or government body for which he or she is acting in the case.

An alternative style of naming litigants acting in official capacity is to append  ‘N.O’, which stands for Nomine Officio, to the surname of the individual. If there is more than one person whose name is followed by N.O., then we use ‘N.N.O.’  This is the practice of case naming in southern Africa.

Note

When an individual is acting both personally and in an official capacity in the case, then the case name refers to this individual when named first.&#x20;

### Ship, Aircraft and Other In Rem Party

When a party listed in the decision’s heading is a thing and no owner is named as a party, this party is referred to by this thing’s name or other identifier – e.g. trademark, model and serial number –, followed between parentheses by a descriptive term such as “Ship” or “Aircraft”, as it appears in the decision’s heading. The name of a ship or vessel should be reproduced as presented in the decision’s heading, including definite articles such as “The” and “Le” if they are part of the name.

### Multiple parties

It’s often the case that there will be more than one person on either side of a matter. Where there are **two people**, the first surname is followed by ‘**and Another**’. Where there are **more than two people**, the first surname is followed by ‘**and Others’**.

Uniform Protection of Identities (Anonymizing)&#x20;

When the identity of a person named in the case name must legally remain undisclosed at some point in court proceedings, the same identity protection should continue throughout any subsequent proceeding in this case as well as in any citation made to this case in other decisions.

The law is not explicit in stating the types of persons whose identity must be protected in published decisions.  Special attention should be paid to:

\-         Persons accused of criminal sex offences, where their name could lead to the identification of a complainant or child witness;

\-         Children and parents involved in proceedings regarding family and child protection;

\-         Young offenders.

Where it is considered to be appropriate to avoid using a name in a decision, the name should be replaced with initials (e.g., “M.L. v. D.L.”). &#x20;

In very rare instances where initials, combined with the facts of the case, would clearly reveal the identity of an individual or of an organization, the letter “X” is used to replace the name instead of initials.  For an additional individual or organization, the letter “Y” is used for the second individual/organization named, then “Z” for the third, “A” for the fourth, “B” for the fifth, and so on.

# Paragraph numbering

This section explains the practice of paragraph numbering and how it assists citation in the digital publication of judgments

Instead of paginating judgments, courts globally have now adopted the practice of assigning paragraph numbers to distinct paragraphs within the text of a judicial opinion.

## Example from the Supreme Court of Namibia

STRYDOM. A.J.A.:

\[1] This is an appeal from the Special Tax Court of Appeal. The respondent ( i.e. the appellant in the Court a quo), objected to a tax assessment by the Receiver of Revenue in terms whereof it was assessed at a rate of 55% of the money recouped in respect of the sale of five of its vessels after they had ceased rendering services in connection with the mining for diamonds to Namdeb Diamond Mining Corporation (Pty) Ltd (“Namdeb”). The respondent maintained that the taxable income, derived from the sale of the vessels, was subject to tax at a rate of 35%.&#x20;

\[2] The respondent’s objection was disallowed by the Commissioner for Inland Revenue. The respondent then launched an appeal to the Special Tax Court where it was successful and where that Court ordered that the assessment of that income be reduced in accordance with the rate of normal tax of 35%.

\[3] The appellant (i.e. the respondent, in the Court a quo) was not satisfied with the outcome of the matter in the Special Tax Court and thereupon appealed to this Court. According to sec. 76(9) of the Income Tax Act, Act 24 of 1981 (as amended), an appeal lies directly to this Court.

There may be a few details to be considered in terms of deciding what constitutes a paragraph and how is a paragraph indicated, but in general those will be addressed at a court level.&#x20;

# Managing flynotes

Flynotes are part of the case summaries generated automatically by AI. On some LII websites, users can explore judgments by flynote topics, which makes discovery and staying up-to-date much simpler.

On websites where this feature is enabled, administrators can manage flynotes in bulk. This includes renaming, merging, and deprecating flynotes. Changes made to the flynote topics will (after some time) reflect on the judgment detail pages for judgments linked to those flynotes.

### Level 1 flynotes

Top-level flynotes are treated specially. When the AI generates flynotes, it MUST choose the top-level flynote from the existing list of flynotes.

Usually, a website has between 50 and 100 top-level flynotes which are used for all judgments.

The AI cannot choose flynotes that are **deprecated.**

### Levels 2, 3, 4 and 5 flynotes

At the remaining flynote levels, the AI will try to choose an existing flynote if a suitable one exists, otherwise it will create a new flynote.

This helps to ensure that we don't have flynotes that vary only in terms of wording (such as plurals, abbreviations).

The AI cannot choose flynotes that are **deprecated.**

## Editing flynotes in bulk

The **Flynote Manager** allows you to edit the flynote tree, and linked judgments will be updated automatically. Use it to keep the flynote tree clean, fix typos and avoid duplication.

### Merging flynotes

Merge flynotes that are very similar.

1. Open the **main flynote** in the flynote manager. This is the flynote that the other flynotes will be **merged into**.
2. Click on the **Merge** tab
3. The manager will show similar flynotes. Use the search box to search for other flynotes you want to merge.
4. For each flynote you want to **merge into** your main flynote, click **Add**.
5. Click **Merge these flynotes** when you are ready to merge.

Deprecating a flynote will cause all linked judgments to have their summaries (and flynotes) re-generated.

**This costs real money, and can take hours.**

What happens when a flynote is deprecated:

1. that flynote, and all descendants, are marked as deprecated
2. the judgments linked to that flynote and any descendants will have their summaries re-generated.
3. the AI will no longer use the deprecated flynotes
4. Once all judgments linked to the deprecated flynote are updated, the flynote will be deleted automatically.

### Deleting a flynote

You can only delete a flynote that does not have any linked judgments, and none of its descendants have linked judgments.

Deleting a flynote deletes all of its descendants.

# How to reset your password

These are the steps to reset your password in a secure and efficient manner.

1. Open a web browser on your device and go to <mark style="color:blue;">lii/admin</mark> to access the administrator page.
2. From the sign-in page, select the **Forgotten password or username?** link or go directly to the <mark style="color:blue;">Password reset page.</mark>

3. On the Password reset page, Enter your **email address** and click the **Reset password** Button.

# Add users

1. Sign In to the **Admin page.**
2. Click **Add Users** on the dashboard.

Bills are proposed laws presented to a legislature for enactment. They must go through several stages of debate, revision, and approval before becoming law.

### How to Upload Bills

1. Select **Bills** from the list of menu items on the dashboard.

**Locality**: If applicable, provide more specific locality details. For bills from African regional bodies, set the locality to the relevant organization. For example, use "East African Community" for EAC-related bills.

**Date**: Enter the date associated with the bill. This could be the date it was introduced, passed, or another relevant date.

**Language**: Indicate the language in which the bill is written, e.g., "English."

**Author**: Enter the name of the entity that issued the bill&#x20;

4. **Upload File:** Click the "Choose File" button to browse your computer and select the file that contains the bill.
5. **Taxonomies:** Click this tab to categorize the bill using predefined tags or categories. This can assist with the organization of bills on pages. For example, EAC bills will be categorised under the **Foreign Legislation topic**
6. **Custom Properties:** This tab is used to track specific information about bills, specifically **sponsor details.**

7. Click **save.**
8. Click **view on site** to view the bill.

# Unpublish/hide a document

Here’s a guide for unpublishing a document on a LII site:

1. Locate and open the document you want to unpublish.&#x20;
2. You can find it in the list of uploaded content under the appropriate category or by searching for its title.
3. Click on the **"Advanced" tab**&#x20;

# Restricted Content

Restrict access to documents and taxonomies to specific groups of users.

Restricted content allows you to control who can view documents and collections. There are two types of restricted content.

1. Restricted documents
2. Restricted taxonomies (collections)

Access to restricted content is controlled through **document access groups**.

## Document access groups

Access to restricted content is controlled through document access groups. Only users that belong to the groups associated with the restricted content can view it.

You must set up the document access groups before you can associate them with restricted documents or collections.

A document access group is visible to the users that belong to the group. A document access group is linked to a **permission group**, which is an internal group to manage user permissions. Users belong to permission groups.

### **Create a permission group**

You must create a permission group before you can create a document access group.

1. Go to groups on your menu items and click to **add group**.

2. Give the group a name. **This name is visible to external users**.
3. Do not add any permissions to the group.
4. Clive **Save**.

### Create a document access group

Now create a document access group that uses the permission group.

1. Navigate to **Document Access Groups** on the left menu.

Access to certain documents can be restricted.

Only users who belong to a document access group group can view restricted documents; others will see an error message.

2. Go to the **Advanced** tab and check the **Restricted** box.
3. Click **Save and continue editing**.

## **Restrict access to taxonomies (collections)**

Access to certain taxonomies (collections) can be restricted.

Only users who have access to the taxonomy will be able to view it; other users will see an error message.

Restricting access to a taxonomy also restricts access to all descendants/sub-taxonomies of that taxonomy. All taxonomies underneath the restricted taxonomy will also effectively be restricted.

### Adding a Relationship

1. Navigate to the document and highlight the specific text, section, or provision you want to link
2. A contextual menu will appear
3. Select **Add relationship**

# Articles (blog posts)

This is a guide on how to add articles (blog posts) to the site.

## Published articles and drafts

The **published** flag controls whether the article is visible to the public. Only published articles are displayed on the website.

If an article is still being written, uncheck the published checkbox until it is ready to be published.

## Featured articles&#x20;

The **Featured** flag determines which article/blog post appears on the LII homepage. Selecting the **Featured** checkbox ensures that the article is displayed on the homepage.

If multiple articles are marked as **Featured**, they are displayed in order of upload, with the most recently uploaded **Featured** article appearing first.

## Article topics

Article topics allow you to create sections on the website blog, similar to sections on a news website. Related articles should be tagged under the same topic.

The available topics can be configured in the **Taxonomies** part of the admin area, under the **Article tags** top-level entry.&#x20;

## How to Upload an article/blog post

1. Select **articles** from the list of menu items on the dashboard.

* **Title** – The main heading of your article.&#x20;
* **Slug** – This is usually auto-generated from the title. It helps form the article’s URL.
* **Date** – This is the publication date of the article. You can manually select a date or use the "Today" shortcut.
* **Image** – An optional field where you can upload an image related to the article.
* **Summary** – A brief description or excerpt of the article, which may be displayed in previews.
* **Body** – This is the main content area where you enter the article text. It includes a rich text editor with formatting options such as bold, italics, the ability to insert images or links, etc.
* **Author** – This field specifies the author of the article. It is required and can be selected from a predefined list. Icons next to this field allow you to change the selected author, add a new one, or view details of the author.

4. Check **published** to make the article visible to the public. Unpublished articles are drafts and are not visible.
5. Check **featured** to put the article on the homepage (selected LIIs only). Only featured articles are shown on the homepage, and ordered by date (most recent first).
6. Upload a cover **image** for the article that will appear at the top of the article and on the listing page. A rectangular image is recommended.
7. **Topics** are the article categories that group articles on the website. Choose article topics carefully to create different sections of the website.
8. The **summary** should be one or two sentences that summarise the article. The summary is shown in the article listing pages and at the top of the article. Add a summary.
9. Enter the article content in the **body section** and format it as needed.
10. Select the **author** for the article from the dropdown menu. The author must be a registered user of the site.

## Article Attachments

* Click the **"Article attachments"**  tab.
* Click the **"Choose File"** button to browse and select a file from your computer.
* If you need to remove an attachment, click the **"Remove"** button next to it.
* To add more attachments, click **"Add another Article attachment"** at the bottom of this section.

11. Click **Save.**
12. Click **View on site** to view the article
13. To edit your article, click the "**Edit**" button, make the necessary changes, and then save your updates.


# Ingestors

Configure ingestors to fetch content into the website.

Ingestors are used to fetch content from other sources and pull them into the website. They can be configured to run periodically (such as every 5 minutes, every hour, or daily) and can also respond in response to a webhook from an external source.

## Ingestor Adapters

Each ingestor is configured with an **adapter** which determines how the ingestor works, and depends on what remote system it is connecting to.

Each adapter has different settings which controls its behaviour.

### IndigoAdapter

The IndigoAdapter fetches content from an Indigo API for a specific place.

### JudgmentDeleteAdapter

The JudgmentDeleteAdapter compares the local collection of judgments (matching its filter settings) to the remote server, and deletes any that the remote server doesn't know about.

Ratification information is only collected for works that exist on the local website.

### GitbookAdapter

The GitbookAdapter fetches Markdown content from a GitHub repo that has been authored using GitBook. It expects the content to match GitBook's file layout and use of Markdown.

The repo can contain multiple documents and the adapter will import all of them, configured by a `peachjam.yaml` file at the root of the repository, using the format:

The website is deployed with [Dokku](https://dokku.com/). Dokku takes care of creating docker images, starting and stopping docker containers, and managing nginx.


# Logs

Viewing system logs

The system produces two sets of logs:

## Application (django) logs

Django emits operational logs to stdout and can be viewed with Docker or via dokku.

To view a snapshot of recent logs with dokku, run:

dokku logs APP
```

To view a continuous stream of logs, run:

dokku logs APP -t
```

You can view logs for a particular process (`web` or `tasks`), run:

The website processes are normal docker containers. You can view the docker logs using standard docker commands, for example:

## Nginx access logs

Nginx writes access logs for all requests to `/var/log/nginx/APP-access.log`. View them with a command such as:

Nginx writes error logs to `/var/log/nginx/APP-error.log`. View them with a command such as:

# Process management

Stop, start and restart the website.

Use dokku to stop, start and restart the docker containers that host the website.

## Background tasks

Background tasks (such as updating the search index and ingesting content from remote sources) are run in a separate docker container.

Normally you only need one or two background task runners. If there are many tasks, you can increase the number of task runners to work through the tasks faster.

The number of background task runners does **not** impact the number of threads or processes serving the website.

For example, to scale up to 3 background task runners, use:

dokku ps:scale APP tasks=3
```

To scale back down to 1, use:

```
dokku ps:scale APP tasks=1
```


# Configure nginx

How to make additional configuration changes to nginx.

The website uses nginx as a reverse proxy. This means that requests from the Internet are served by nginx, which forwards them to Django, and then returns the response to the user.

## Config file location

Dokku places a single config file into the main nginx config directory at `/etc/nginx/conf.d/dokku.conf`.

That file loads individual config files for each dokku app.

The nginx configuration used for the website is stored at  `/home/dokku/APP/nginx.conf`.

## Additional config files

The app's main nginx configuration file dynamically includes the files  `/home/dokku/APP/nginx.conf.d/*.conf` .  These files are included as part of the `server` nginx configuration block.&#x20;

You can put additional files into this directory to customise the nginx configuration. Once you have added a file or made changes, you must tell nginx to reload its configuration.

First, ask nginx to test that the configuration is valid:

```
sudo service nginx configtest
```

If that shows an error, look at the log output in `/var/log/nginx/error.log` for more details.

If nginx is happy with the changes, tell it to re-load its configuration:

```
sudo service nginx reload
```

# Renew SSL certificate

How to renew an SSL certificate.

The website's SSL certificate is provided for free by [LetsEncrypt](https://letsencrypt.org/) and is managed using the [dokku letsencrypt plugin](https://github.com/dokku/dokku-letsencrypt).

In most cases the certificate is renewed automatically by a cron job installed with `dokku letsencrypt:cron-job --add`.&#x20;

If necessary, you can renew a certificate using:

dokku letsencrypt:auto-renew APP
```


# Block an IP address

How to block an IP address

If your website comes under load from a bad IP address, use nginx to block it.

Edit (or create) the file `/home/dokku/APP/nginx.conf.d/block.conf`.

In that file, add the nginx `deny` setting for the IP, such as:

deny 10.20.30.40;
```

Validate the nginx config with:

```
sudo service nginx configtest
```

If nginx is happy, then reload nginx's config:

sudo service nginx reload
```

# Supprimer un Jugement

Comment retirer un jugement du site une fois qu'il a été téléchargé.

Lorsque vous disposez d'un accès d'éditeur sur un site LII, vous pouvez supprimer un jugement que vous avez téléchargé et, pour les utilisateurs disposant de droits d'administrateur, vous pouvez supprimer n'importe quel jugement.

# Remplacer un fichier source

Vous pouvez remplacer les fichiers sources directement sur le site dans tous les jugements que vous avez téléchargés de manière incorrecte sans avoir à les supprimer.

1. Dans le tableau de bord, accédez à la liste des jugements et **recherchez** le jugement que vous souhaitez modifier.
2. Cliquez sur le jugement que vous souhaitez modifier.
3. Sélectionnez **les fichiers sources** et cliquez sur Choisir un fichier.
4. **Remplacez** le fichier existant par le fichier que vous souhaitez remplacer.

# Publication des Principes du Droit

Cette page présente les principes généraux régissant la publication des jugements sur le web.

## Que publions-nous?

Un institut d'information juridique publie des documents juridiques primaires nécessaires pour effectuer des recherches juridiques de base ainsi que des documents juridiques secondaires appropriés, tels que des revues juridiques, des publications de commissions de réforme du droit, des documents universitaires et d'autres documents de recherche.

Lors de l'organisation d'une collection nationale de documents juridiques primaires, le LII sera guidé par la doctrine des sources du droit applicable au système juridique national.

Par conséquent, la collection nationale se concentrera sur l'approvisionnement et la publication des éléments suivants, dans l'ordre indiqué:

1. La Constitution
2. La législation, primaire et subsidiaire, qui peut être organisée en collections thématiques
3. La jurisprudence par ordre d'importance:
   * Cour suprême (par exemple, la Cour suprême)
   * Cour d'appel
   * Hautes cours, y compris les distinctions entre les divisions commerciales, pénales, civiles, etc.

Les jugements historiques sont également importants pour les chercheurs en droit. La numérisation des jugements historiques doit être prévue dans un plan de numérisation.&#x20;


# Principes de développement des collections

### L'exhaustivité

Aucune distinction n'est faite entre les cas à signaler et les cas non signalés. Tous sont publiés sur LII.

### L'autorité

* Dans la mesure du possible, LII s'approvisionne directement auprès de la cour, du tribunal, de l'organe législatif ou du journal officiel. L'utilisation de documents authentiques provenant de la source est la base de la confiance dans les informations et les services offerts par LII.
* D'autres sources de documents juridiques seront prises en considération sous réserve de la fiabilité/l'autorité de la source et/ou de la validation du contenu d'une autre source, de préférence le tribunal (pour les jugements) ou le Journal Officiel du gouvernement/le bureau de l'AG pour la législation.

### Monnaie

* Les dossiers en cours sont traités en priorité.
* Des lots quotidiens de jugements historiques sont traités dans la mesure du possible.

### La politique linguistique

* Les jugements sont publiés dans leur langue d'origine.
* Leurs traductions, si elles sont disponibles, doivent être clairement identifiées.
* Les intitulés des dossiers sont désignés dans la langue d'origine du jugement.

### L'authenticité

* Les jugements sont publiés dans le format - Word ou PDF - reçu du juge ou du greffe du tribunal. Si les jugements subissent une quelconque forme de conversion numérique, le document original du jugement est annexé au dossier.
* Les jugements constitués des opinions (dissidentes ou concordantes) de plusieurs juges dans la même affaire seront combinés en un seul document par LII, indépendamment de leur réception en tant que documents distincts du greffe ou de la bibliothèque de la Cour. **Le jugement ainsi combiné recevra une seule citation, apparaissant sous un seul enregistrement (page).**

### &#x20;Le format

* Les jugements sont téléchargés sur le système dans le format fourni par le greffe ou les secrétaires des juges.
* Le format privilégié est un document Word.&#x20;
* La disponibilité des PDF est obligatoire pour les jugements scannés. Ils servent de version de vérification lorsqu'un logiciel de reconnaissance optique de caractères est utilisé pour produire une version texte/page web des arrêts publiés sur LII.

#### Corrections des jugements

* **LII ne corrige pas les jugements**. Pas même les fautes d'orthographe ! Les corrections effectuées par la Cour et reflétées dans un nouveau jugement doivent être clairement indiquées sur la version publiée d'un document sur LII. Un avis tel que celui-ci:

<mark style="background-color:yellow;">Note de l'éditeur : Ce jugement a été corrigé par la Cour, et cette version a été mise en place le \[La date].</mark>

L'avis doit être placé sur toutes les versions du jugement au tout début du document. La version antérieure de ce jugement doit être conservée dans le dossier si elle doit être consultée par les utilisateurs et/ou le juge. Le logiciel du site web de LII prévoit cette fonction.

### L'anonymisation

En principe, il incombe aux tribunaux de veiller à ce que les exigences en matière de protection de la vie privée soient respectées en ce qui concerne les informations personnelles contenues dans les jugements. Toutefois, dans certaines juridictions, le LII a la responsabilité d'expurger certains jugements de détails personnels et privés afin de protéger l'identité des personnes et des groupes vulnérables de la société, en particulier lorsque la loi ou une décision de justice l'exige.

Cette exigence varie d'une juridiction à l'autre et chaque LII devrait élaborer ses propres lignes directrices en matière d'anonymisation.

### La rétrospectivité

* La priorité est donnée aux décisions actuelles, c'est-à-dire que les années 2005 et suivantes doivent être collectées et publiées. L'année 2005 correspond approximativement à l'année où les tribunaux ont commencé à informatiser et vraisemblablement à stocker les jugements sous forme électronique.
* En principe, il n'y a pas de date limite pour les décisions antérieures, mais les dossiers les plus récents seront chargés en premier, en fonction des disponibilités.
* Les utilisateurs seront aidés si le plan de collecte de LII comprend une liste de jugements importants publiés dans le passé et de précédents encore en vigueur, qui doivent être scannés en priorité et téléchargés sur le service. Cela représente une valeur ajoutée considérable pour les utilisateurs, avec moins d'efforts et d'engagement financier de la part du LII. Un bon point de départ pourrait être la publication électronique des Rapports de Loi ou la consultation des livres et des listes de lecture des facultés de droit pour les cas les plus utilisés dans l'enseignement du droit et, par la suite, dans la pratique. Les logiciels Laws.Africa et AfricanLII peuvent identifier et répertorier tous les jugements qui ont été cités mais qui ne peuvent être trouvés dans le système.

### MNC - La Citation Neutre pour les Médias

* Aucun jugement ne sera chargé sur LII sans qu'une mention de neutralité moyenne ne lui ait été attribuée. Vous trouverez ci-dessous une explication de la norme MNC.
* Les jugements paraphrasés sont préférables, mais **LII n'insère pas de numéros de paragraphes**, car cela nuirait à l'autorité et à l'intégrité du jugement.
* Le LII devrait inclure cette question dans ses engagements politiques avec les tribunaux du pays. La citation électronique et l'adoption complète des jugements électroniques dépendent de l'utilisation d'une citation précise : une combinaison des numéros de MNC et de paragraphe dans un jugement particulier.

### Résumés des tribunaux&#x20;

* Lorsque les tribunaux publient des résumés de jugements, le LII doit les rassembler pour les publier. Le système permet de lier ou d'afficher les résumés de plusieurs façons.


# Lignes directrices pour la dénomination des dossiers

Les lignes directrices suivantes sur la dénomination des dossiers sont basées sur les conventions de dénomination des dossiers en vigueur dans les pays de common law.

## Le style de la police

Les noms doivent être correctement capitalisés. **L'utilisation de majuscules entières dans les dossiers n'est pas souhaitable et doit être évitée**. La pratique consistant à utiliser des majuscules dans la saisie des parties peut entraîner une confusion quant à l'orthographe correcte des noms des parties.&#x20;

Par exemple, "MACDOUGALL" et "MacDougall".

## Langage

Le nom du dossier est créé dans la même langue que les motifs de décision auxquels il est associé. Lorsqu'une partie a un nom bilingue, seul le nom correspondant à la langue des motifs est retenu.

#### Note

En cas d'incertitude sur la manière de séparer le nom de famille du nom complet - ce qui peut arriver plus souvent pour les noms à particule, les noms traditionnels ou les noms d'origine étrangère - essayez de trouver des indices dans le texte de la décision ou essayez de localiser d'autres décisions impliquant cette partie. En cas de doute, ne conservez que le dernier mot du nom complet de la personne.

### Affaires ex parte

Dans certaines situations, une personne ou un groupe de personnes présente une demande au tribunal lorsqu'il n'y a pas de conflit de fait et donc pas de partie adverse, par exemple lorsqu'une personne demande à être admise en tant qu'avocat ou qu'une personne demande à ce que sa succession insolvable soit remise. Ces demandes sont appelées "ex parte". Une demande ex parte est souvent liée à une autre affaire en cours, ce qui signifie que la citation doit inclure à la fois le nom de l'affaire ex parte et le nom de l'affaire à laquelle elle est liée. Par exemple, une personne peut demander à être associée à un litige qui ne l'incluait pas à l'origine, ou un plaideur peut demander que des biens en possession de son débiteur soient saisis d'urgence au milieu d'un procès civil. ### Navires, Aéronefs et autres In Rem Party

Lorsqu'une partie énumérée dans le titre de la décision est une chose et qu'aucun propriétaire n'est désigné comme partie, cette partie est désignée par le nom de cette chose ou par un autre identifiant - par exemple une marque, un modèle et un numéro de série -, suivi entre parenthèses d'un terme descriptif tel que "navire" ou "aéronef", tel qu'il apparaît dans le titre de la décision. Le nom d'un navire ou d'un bateau doit être reproduit tel qu'il figure dans l'intitulé de la décision, y compris les articles définis tels que "Le" et "The" s'ils font partie du nom.

Il arrive souvent que plus d'une personne soit impliquée dans un dossier. Lorsqu'il y a **deux personnes**, le premier nom de famille est suivi de **et autres**. Lorsqu'il y a plus de deux personnes, le premier nom de famille est suivi de **et autres**.

Protection Uniforme des Identités (Anonymat)&#x20;

Lorsque l'identité d'une personne citée dans l'intitulé du dossier doit légalement rester secrète à un moment donné de la procédure judiciaire, la même protection de l'identité doit être maintenue tout au long de la procédure ultérieure dans ce dossier ainsi que dans toute citation de ce dossier dans d'autres décisions.

La loi n'est pas explicite quant aux types de personnes dont l'identité doit être protégée dans les décisions publiées. Une attention particulière doit être accordée:

\-         Les personnes accusées de délits sexuels, lorsque leur nom peut permettre d'identifier un plaignant ou un enfant témoin;

\-         Enfants et parents impliqués dans des procédures relatives à la protection de la famille et de l'enfant;

\-         Jeunes délinquants.

Lorsqu'il est jugé approprié d'éviter l'utilisation d'un nom dans une décision, le nom doit être remplacé par des initiales (par exemple, "M.L. c. D.L."). &#x20;

Dans les très rares cas où les initiales, combinées aux faits du dossier, révéleraient clairement l'identité d'une personne ou d'une organisation, la lettre "X" est utilisée pour remplacer le nom au lieu des initiales. Pour une personne ou une organisation supplémentaire, la lettre "Y" est utilisée pour la deuxième personne/organisation nommée, puis "Z" pour la troisième, "A" pour la quatrième, "B" pour la cinquième, et ainsi de suite.

Les mêmes initiales sont utilisées pour remplacer chaque occurrence du nom d'une personne ou d'une organisation dans l'ensemble du jugement, y compris les pages de couverture et les résumés, même s'il y a des variations dans la façon dont cette personne/organisation est désignée dans la décision.

Si le juge a expressément utilisé un nom fictif pour remplacer un nom réel, ce nom fictif doit être utilisé dans toute la décision.

Lorsque le nom d'une personne doit être remplacé, les initiales complètes du nom sont utilisées : une initiale pour chaque prénom et une initiale pour le nom de famille.

# Citation

&#x20;Dans le cadre de la gestion de votre dossier pour l'IIL, vous travaillerez avec deux types de citations:

* **Une citation imprimée**, par exemple KWADWO c. SONO \[1984-86] 1 GLR 7-16, qui sera dorénavant désignée comme une citation de recueil de lois ou une citation parallèle ; et
* **Medium Neutral Citation (MNC)** - une norme mondiale pour la publication électronique des arrêts. Le système LII vous permettra d'afficher les deux sur le site web, ce qui facilitera la recherche d'informations pour les chercheurs.

Le système LII attribue automatiquement des MNC à moins qu'un éditeur ne passe outre l'attribution en saisissant le MNC attribué par un tribunal.


# Introduction à la citation neutre

Cette section présente à l'éditeur la norme MNC (Medium Neutral Citation) et la numérotation des paragraphes.

La profession juridique s'appuie sur l'autorité (jurisprudence et législation) et sur une littérature juridique secondaire convaincante (ouvrages savants, travaux préparatoires, dictionnaires, etc.) pour construire et présenter des arguments juridiques. L'objectif principal de la citation de dossiers est d'identifier avec précision une opinion judiciaire ou une partie de celle-ci - traditionnellement, son emplacement dans une série de recueils de jurisprudence imprimés.

Dans les recueils de jurisprudence traditionnels, les citations d'arrêts ne contiennent pas d'informations sur le dossier lui-même, mais indiquent l'année, le volume et le numéro de page du ou des recueils de jurisprudence qui contiennent l'avis judiciaire. Les références à des parties spécifiques d'un avis judiciaire (référence précise) sont également basées sur le numéro de page et la lettre du paragraphe.

La numérisation des avis judiciaires permet aux tribunaux de rendre les jugements immédiatement disponibles sur l'internet ou d'autres médias, contrairement aux éditeurs commerciaux qui prennent entre un mois et parfois des années pour publier un jugement dans les recueils de jurisprudence. Bien que cela ait un impact évident sur l'accessibilité des avis judiciaires, la profession juridique et les médias ont toujours besoin d'une méthode fiable pour référencer ces décisions électroniques. Des substituts aux citations attribuées par les éditeurs commerciaux et aux numéros de page doivent accompagner ces jugements.

A Une étude des pratiques internationales en la matière montre que les tribunaux ont pris des mesures pour résoudre ces problèmes en introduisant des citations neutres et la numérotation des paragraphes dans les versions finales des jugements.

La citation neutre du point de vue du support (MNC) permet de citer une ressource telle qu'un jugement, quel que soit son support de publication, à savoir sous forme imprimée ou sous forme électronique, indépendamment du fait qu'ils ont été ou seront publiés dans une série de recueils de jurisprudence imprimés. **Le MNC sert d'identifiant unique permanent attribué par l'auteur du jugement et doit rester associé au jugement quel que soit le support publié ou la publication.**

Le MNC améliore la lisibilité des arrêts dans les publications, telles que les séries de rapports de droit commercial, LII et d'autres sites web.

Le MNC comprend un identifiant global de la juridiction émettrice, composé du code de pays à deux lettres de la norme ISO-3166-1 et d'une abréviation du nom du tribunal. Il s'agit de GH pour le Ghana, TZ pour la Tanzanie, CI pour la Côte d'Ivoire.

Le MNC doit être attribué par la juridiction à la version finale (version de dépôt et de distribution) des jugements. ## Nom du dossier

### Succession d'une personne décédée

### Personne agissant à titre officiel

Une personne dont le nom figure dans l'intitulé de la décision uniquement en raison de sa fonction au sein d'une organisation ou d'un organe gouvernemental n'agit pas à titre personnel. Par conséquent, l'intitulé du dossier ne doit pas faire référence à cette personne mais à l'organisation ou à l'organe gouvernemental pour lequel elle agit dans le dossier.

### Navires, avions et autres In Rem Party&#x20;

Lorsqu'une partie énumérée dans le titre de la décision est une chose et qu'aucun propriétaire n'est désigné comme partie, cette partie est désignée par le nom de cette chose ou par un autre identifiant - par exemple une marque, un modèle et un numéro de série -, suivi entre parenthèses d'un terme descriptif tel que "navire" ou "aéronef", tel qu'il apparaît dans le titre de la décision. Le nom d'un navire ou d'un bateau doit être reproduit tel qu'il figure dans l'intitulé de la décision, y compris les articles définis tels que "Le" et "The" s'ils font partie du nom.

### Parties multiple

Il arrive souvent que plus d'une personne soit impliquée dans un dossier. Lorsqu'il y a **deux personnes**, le premier nom de famille est suivi de **"et autres"**. Lorsqu'il y a plus de deux personnes, le premier nom de famille est suivi de **"et autres"**.

Protection uniforme des identités (Anonymisation)

Lorsque l'identité d'une personne citée dans l'intitulé du dossier doit légalement rester secrète à un moment donné de la procédure judiciaire, la même protection de l'identité doit être maintenue tout au long de la procédure ultérieure dans ce dossier ainsi que dans toute citation de ce dossier dans d'autres décisions.

La loi n'est pas explicite quant aux types de personnes dont l'identité doit être protégée dans les décisions publiées. Une attention particulière doit être accordée aux personnes suivantes:

\-         Les personnes accusées de délits sexuels, lorsque leur nom peut permettre d'identifier un plaignant ou un enfant témoin ;

\-         Enfants et parents impliqués dans des procédures relatives à la protection de la famille et de l'enfant ;

\-         Young offenders.

Where it is considered to be appropriate to avoid using a name in a decision, the name should be replaced with initials (e.g., “M.L. v. D.L.”). &#x20;

In very rare instances where initials, combined with the facts of the case, would clearly reveal the identity of an individual or of an organization, the letter “X” is used to replace the name instead of initials.  For an additional individual or organization, the letter “Y” is used for the second individual/organization named, then “Z” for the third, “A” for the fourth, “B” for the fifth, and so on.

The same initials are used to replace each occurrence of an individual or an organization’s name throughout the judgment, including cover pages and summaries, even if there are variations in the way this individual/organization is referred to in the decision.

If the judge has expressly used a fictitious name to replace a real name, this fictitious name must be used throughout the decision.

When the name of an individual must be replaced, the full initials of the name are used: one initial for each forename and one initial for the surname.

Only one initial is used for a compound or hyphenated forename or surname.

Au lieu de paginer les jugements, les tribunaux ont globalement adopté la pratique d'attribuer des numéros de paragraphe à des paragraphes distincts dans le texte d'un avis judiciaire.

## Exemple de la Cour Suprême de Namibie

STRYDOM. A.J.A.:

\[1] Il s'agit d'un appel de la Special Tax Court of Appeal. Le défendeur (c'est-à-dire l'appelant dans la Cour a quo) s'est opposé à un avis d'imposition du receveur des recettes en vertu duquel il a été imposé à un taux de 55% de l'argent récupéré lors de la vente de cinq de ses navires après qu'ils aient cessé de rendre des services dans le cadre de l'extraction de diamants à Namdeb Diamond Mining Corporation (Pty) Ltd ("Namdeb"). La partie défenderesse a soutenu que le revenu imposable, dérivé de la vente des navires, était soumis à l'impôt au taux de 35 %.

# Comment réinitialiser votre mot de passe

Voici les étapes à suivre pour réinitialiser votre mot de passe de manière sûre et efficace.

1. Ouvrez un navigateur web sur votre appareil et allez sur LII/admin pour accéder à la page de l'administrateur.
